Registration of title to an apartment in Ukraine
When buying or inheriting real estate, an obligatory stage is the registration of ownership. Let's take a closer look at what documents are needed for this in different situations, where to apply for registration, how everything happens and how much you have to pay for the procedure.
What documents are needed to formalize ownership of an apartment
To formalize the ownership of an apartment, you used to apply only to a notary. Now it is possible to execute the relevant document not only at a notary, but also at the Central Register Office (CNAP). In the latter case, the applicant's documents are considered by the state registrar.
The list of documents for applying for title registration may differ depending on what kind of apartment is being bought, who is buying it, and what method of payment has been chosen. There are also differences when formalizing ownership of an object received as an inheritance. Let us consider each situation separately.
When buying an apartment in a new building
When buying real estate from a developer, you need to understand that not always the construction company takes over the re-registration of ownership: most often this is done by the buyer himself.
The first thing the owner of a new building needs to do is to produce a technical passport. To obtain it, you will need a package of documents: passport, TIN, investment agreement with the developer and additional agreements to it, act of acceptance of the real estate object. Production of technical passport takes about 5 days and costs from 400 UAH.
When formalizing the title to an apartment in a new building you will need the following documents:
passport, identification code;
contract with the developer, additional agreements;
apartment acceptance certificate;
documents on commissioning of the object and assignment of the postal address;
certificate of full payment for the real estate;
technical passport.
When buying an apartment on the secondary market
If in the case of buying a new home, the registration of the title of ownership takes place after the conclusion of the transaction, when buying an apartment on the secondary market, the title of ownership is registered simultaneously with the conclusion of the purchase and sale agreement. For this reason, you will not have to prepare separate documents, as you will already have the necessary package for signing the main contract.
When buying an apartment on the secondary market and formalizing the title of ownership will need the following documents:
passport, identification code;
document confirming the title to the property (from the seller);
technical passport for the apartment;
a receipt for payment of a certificate from the State Register;
a receipt for payment of the administrative fee.
When buying an apartment with a mortgage in a new building
If the apartment is purchased not with full payment, but with the registration of a mortgage, the package of documents will be slightly different. To register ownership in this case, the following documents will be needed:
act of acceptance of transfer of the real estate object;
investment agreement signed with the developer;
mortgage agreement with the bank;
a document of full payment of the cost of the apartment to the developer;
technical passport for the apartment, drawn up by certified engineers;
passport, identification code;
documents for the house from the developer;
a receipt for payment of the state duty.
Buying an apartment on the secondary market with a mortgage
Mortgage loan can be issued not only when buying an apartment in a new house from the developer. You can also take a mortgage for secondary housing. If the property is purchased in this way in the secondary market, then the following documents are needed:
original passports, TIN (both parties);
relevant applications (from the seller and the buyer);
a receipt for payment of the state duty;
documents confirming ownership of the apartment (from the seller);
mortgage agreement;
certificate of absence of persons registered in the apartment;
certificate of absence of debts on utility payments;
written consent to the sale of the apartment (if there are co-owners);
consent of the guardianship and custody authorities (if there are minors among the co-owners).
When buying an apartment in Ukraine by a foreigner
The legislation of Ukraine does not prohibit the purchase of real estate to foreign citizens, so in such a situation also arises the question of registration of ownership. And there are its own nuances here.
If a foreigner buys an apartment in Ukraine, he must be in the country legally and be over 18 years of age. It will also be necessary to translate all the documents necessary for the transaction into Ukrainian. To do this, you should contact a professional translator and then have the translations certified by a notary.
When buying an apartment in Ukraine by a foreign citizen will need such documents:
passport of his/her country or residence permit in Ukraine;
tax payer identification number (to be obtained in Ukraine);
written consent for the conclusion of the transaction from the spouse.
It is possible to register the title to one apartment for several foreigners at the same time. In this case, they become co-owners of the real estate object, which is not prohibited by the Ukrainian legislation.
When receiving an apartment as an inheritance
When receiving real estate as an inheritance, it is also necessary to re-register ownership. In this case, the main document will be a certificate of right to inheritance. To obtain it, you need to apply to a notary within 6 months from the date of the testator's death. At this stage you will need the following documents: death certificate, will, documents on the ownership of the apartment in the name of the testator, documents on the relationship between the heir and the testator, technical passport (production term - no more than 1 year ago), certificates that confirm the composition of the family and the last place of residence of the deceased.
After the certificate of right to inheritance is ready, you can deal with the registration of ownership. To do this, you will need the following documents:
passport, TIN;
document of ownership of the apartment in the name of the testator;
certificate of inheritance;
technical passport for the real estate object.
How the registration of title to an apartment takes place: the main stages
The process of registering ownership of real estate always begins with the preparation of the necessary documents. Only when the entire package is collected, you can go to a notary or a state registrar at the CCPAU (CCNAP) of your choice.
In the registration of ownership of an apartment, you can distinguish the following main stages:
Filling out an application in two copies, in which it is necessary to specify the full details of the future owner. One form with the relevant mark remains with the applicant, the other with the registrar. If the title is issued by a third party, a notarized power of attorney is required.
Submission of a package of documents and a mandatory receipt for payment of the state duty. If the applicant belongs to a privileged category and is exempt from paying the state duty, he or she shall provide a certificate confirming this right.
Assignment of a priority number for consideration of the application by the registrar.
Expert verification of documents to detect errors or inaccuracies that may be a reason for refusal to register ownership.
Creation of a section in the register of rights by a state registrar in the event of a positive decision to register ownership. The document of ownership is formed only in electronic form.
Receipt of an extract from the register by an apartment owner. The extract is an ordinary A4 sheet printed out on a printer, with no signatures or stamps on it. You can print out such an extract at any time on the website of the Ministry of Justice.
From the moment the application is submitted until the extract is received, it takes 5 days for the documents to be thoroughly checked.
How much it costs to formalize the title to an apartment
The cost of registration of ownership of real estate depends on whether it is a new building or the secondary market. In the first case, registration will cost less.
You will have to spend from 1000 to 4000 UAH to register the title to an apartment in a new building. It all depends on whether the buyer will do it himself or entrust the issue to the developer. If you do it yourself, you will have to pay about 1000 UAH, and these costs include the production of a technical passport. If you order the service from the developer, it will cost about 100 dollars. If the documents are needed urgently, you will have to pay even more.
If we are talking about the secondary market, you have to pay a state duty of 1% of the value of the apartment when registering ownership. It is also necessary to include in the expenses payments to the Pension Fund, which also amount to 1% of the estimated value of the object.
