How to check the ownership of an apartment in the State Register

Checking the title to an apartment in the registry allows you to make sure that your real estate information is up to date and correct. It is an easy way to make sure that your property is in good order - especially before selling, inheriting or donating it.

In this article we will look at where you can check the ownership of an apartment, how to do it correctly online and what to do if it turns out that the information about the property is not true.

Where to check the ownership of real estate

You can check the ownership of real estate in Ukraine offline and online. If the first option is suitable, you can obtain an information extract by applying to the Center for Provision of Administrative Services, i.e. the CPAU or in Ukrainian - CNAP. The owner of real estate can come to any CPAU regardless of the place of registration.

What the owner must have when applying to the CPAM:

  • passport of a citizen of Ukraine or other document to confirm identity (if the documents are submitted by an authorized person, he/she must have a power of attorney with him/her);

  • a document on payment of the fee for providing information from the State Register of Property Rights to immovable property (if the applicant is exempt from paying the administrative fee, he/she must show the relevant document).

When obtaining the service at the CPAU, you can use the documents from Annex Diya. The fee for providing the service is 0.025 of the subsistence minimum, i.e. 60 UAH.

It is also possible to obtain a statement of ownership through a private notary or a lawyer. This option is suitable for those who do not have an electronic signature.

How to check the ownership of an apartment online

It is much easier and faster to check the ownership of real estate online. You will need any gadget, internet access and 10 minutes of free time. The result will be available in about an hour.

You can get an extract of ownership of real estate on the official website of the Ministry of Justice, but this method may take more time. It is much more convenient to do everything through the Diya portal. In addition, this option allows you to obtain data from all available registers, including statements about mortgages and restrictions on alienation.

To obtain information from the State Register of Property Rights to Real Estate, you need a qualified electronic signature. It can be done through a bank, the State Tax Service or the Ministry of Internal Affairs.

How to get a statement of ownership of real estate online through Diya:

  1. Register or authorize in the citizen's cabinet at diia.gov.ua using an electronic signature.

  2. Make sure that the correct personal data are specified in the profile, or update them if necessary.

  3. Select the service "Provision of information from the State Register of Property Rights to Immovable Property".

  4. Fill in the online form specifying the search criterion for obtaining information from the State Register of Property Rights to Real Estate. It is possible to obtain an extract about a real estate object not only from the State Register of Property Rights to Real Estate, but also from the Register of Property Rights to Real Estate, the State Register of Mortgages, the Unified Register of Prohibitions on Alienation of Real Estate Objects.

  5. Pay the administrative fee.

  6. Receive information from the registers in PDF format in the "Services" - "Received Documents" section.

It takes about 10 minutes to submit a request in this way. The cost of the extract is 40 UAH, but may vary depending on the amount of information. There is no administrative fee exemption for this service.

If no information is found on the request, you can try to refine the search parameters or select a different criterion. If the extract shows someone else's property, it is worth trying to repeat the search by other parameters, for example, by passport or identification code.

It is also possible to obtain a statement of ownership of real estate for another person. To do this, in the search parameters you need to specify the data of the owner whose property you need to obtain a certificate for.

How to get an extract on the website of the Ministry of Justice:

  1. Go to the site minjust.gov.ua and create a personal account with an electronic digital signature.

  2. Click "Online Services" and go to the section "Information from the State Register of Real Property Rights to Real Estate".

  3. Apply for information about real estate and its owner.

  4. Pay the service fee.

  5. Receive the extract to the e-mail specified during registration.

After receiving the extract in Diya or on the website of the Ministry of Justice, it is necessary to check whether the data in it coincide with the original documents of title, e.g. purchase and sale agreement, deed of gift, certificate of privatization, certificate of ownership, etc.

What to do if information about the apartment has been changed

In case of any failure in the work of the Registry, information is restored from archive copies, but not everyone can answer the question with what frequency these archive data are created. If the slightest discrepancies are detected (even those that may seem insignificant), it is best to immediately initiate an amendment to the Registry to ensure that it contains only up-to-date data.

In order to enter the correct information, it is necessary to apply to the Ministry of Justice with an application for correction of the detected errors and supplement it with a copy of the documents of title. It is not worth ignoring this issue or putting it off in a "long box", even if it seems to be an insignificant problem, because later it can turn into serious financial and time costs.

If it turns out that the property in ownership is registered to another person, in this case it is necessary not only to apply to the Ministry of Justice, but also to write a criminal complaint to the police.
